Rubbish Removal Haringey Service Terms and Conditions

These Terms and Conditions set out the basis on which Rubbish Removal Haringey provides rubbish clearance, waste collection and related services to domestic and commercial customers. By placing a booking with us, you agree to be bound by these Terms and Conditions, which form a legally binding agreement between you and Rubbish Removal Haringey.

These Terms and Conditions are intended to comply with applicable laws and regulations in England and Wales relating to waste management and consumer rights. Please read them carefully before making a booking. If you do not agree to these terms, you must not use our services.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

1.1 "We", "us" and "our" refer to Rubbish Removal Haringey, the provider of rubbish removal and waste collection services.

1.2 "You" and "your" refer to the person, business or organisation placing a booking or using our services.

1.3 "Services" means any rubbish removal, waste collection, clearance, loading, transportation, recycling or disposal services we agree to provide.

1.4 "Site" means the address or location where the rubbish or waste is to be collected or where we provide any part of the services.

1.5 "Waste" or "rubbish" means the items, materials, goods or substances that you ask us to remove, subject to these Terms and Conditions and applicable waste regulations.

2. Scope of Services

2.1 We provide rubbish removal and waste collection services to domestic households, landlords, letting agents, businesses and other organisations within our designated service area. Our services may include clearance of household waste, bulky items, garden waste, light construction waste, office waste and similar rubbish, subject to legal and safety restrictions.

2.2 We reserve the right to refuse collection of certain types of waste, including but not limited to hazardous materials, clinical or medical waste, asbestos, chemicals, liquids, pressurised containers, gas bottles, explosives, and any other items that we, in our reasonable opinion, deem unsafe, illegal or unsuitable for standard collection.

2.3 We will perform the services with reasonable care and skill, in accordance with applicable waste regulations and industry practice, and will use reasonable endeavours to divert waste from landfill by prioritising re-use and recycling where practical.

3. Booking Process

3.1 You may request a booking by telephone, email, online form, or other method we make available. When you provide details of the rubbish to be collected, you must give accurate and complete information, including the type, approximate volume or weight of rubbish, access conditions at the site and any parking restrictions.

3.2 Based on the information you provide, we may give you an initial quotation or estimated price. Any such quotation is indicative only and is not binding until we have inspected the waste at the site and confirmed the final price before starting work.

3.3 A booking is only confirmed when we have accepted your request, agreed a collection date and time window, and you have accepted our pricing and these Terms and Conditions. We may confirm your booking verbally, by email, text message or other written communication.

3.4 You must ensure that an authorised person is present at the site at the agreed time to provide access, identify the waste to be collected and approve the final price. If no one is present, or access is not available, this may be treated as a cancellation and you may be charged a call-out or cancellation fee.

4. Pricing and Payments

4.1 Our pricing is generally based on the volume and type of rubbish collected, as well as factors such as loading time, access conditions, distance, parking costs and disposal fees. We will explain our pricing structure to you before starting work.

4.2 The final price will be confirmed once our team has inspected the rubbish at the site. If the amount or type of waste differs significantly from the description you provided when booking, the price may change accordingly. You will be informed of any change and have the opportunity to accept or decline before we begin the clearance.

4.3 Unless we have agreed otherwise in writing, payment is due in full on completion of the services and before our team leaves the site. We may accept payment by cash, debit or credit card, bank transfer, or other methods we specify from time to time.

4.4 For business customers or account holders, we may agree alternative payment terms in writing, such as payment by invoice within a specified period. If payment is not received by the due date, we reserve the right to charge interest on overdue sums at the applicable statutory rate and to recover our reasonable costs of debt collection.

4.5 All prices are quoted exclusive of any applicable taxes unless we state otherwise. If value added tax or any other tax becomes payable in relation to the services, you will be responsible for paying such amounts in addition to our charges.

5. Cancellations, Rescheduling and Access

5.1 You may cancel or reschedule your booking by contacting us as soon as possible. Where you give us at least 24 hours notice before the agreed collection time, no cancellation fee will normally apply, unless we have incurred specific costs that cannot be recovered.

5.2 If you cancel or reschedule with less than 24 hours notice, or if we attend the site at the agreed time and are unable to carry out the services due to lack of access, incorrect information, absence of an authorised person, or refusal of the confirmed price, we may charge a reasonable cancellation or call-out fee to cover our time, travel and administrative costs.

5.3 We may cancel or reschedule your booking where we are unable to provide the services due to circumstances beyond our reasonable control, including severe weather, traffic delays, accidents, vehicle breakdown, staff illness, industrial action, or compliance with legal or regulatory requirements. In such cases, we will use reasonable endeavours to notify you as soon as possible and arrange a new collection time.

5.4 You must ensure that our team has safe, reasonable and lawful access to the site, including suitable parking for our vehicle as close as possible to the collection point. You are responsible for obtaining any necessary parking permissions or permits and for paying any parking charges or penalties that arise due to your failure to provide correct information or authorisation.

6. Customer Responsibilities

6.1 You are responsible for ensuring that the waste you present for collection is safe to handle, has been described accurately and does not include prohibited items such as hazardous waste, sharp or dangerous materials, or any items that are unlawful to transport or dispose of through our service.

6.2 You must separate any items that you do not wish to be removed and clearly indicate the rubbish to be collected. Our team will rely on your instructions at the site, and we will not be liable for removing items that you failed to identify as not for disposal.

6.3 Where the collection involves internal areas, lofts, basements, gardens or outbuildings, you must ensure that access routes are clear, safe and free from obstruction or hazards. We reserve the right to refuse to work in areas that we consider unsafe or unsuitable.

6.4 If you or your representative ask our team to move items or waste from higher floors, confined spaces or difficult access points, you acknowledge that this may involve increased risk and additional time, and you agree that we may charge a reasonable additional fee for such work.

7. Waste Handling and Regulations

7.1 We operate in compliance with relevant UK waste management legislation and regulations, including duties relating to the transport, transfer and disposal of controlled waste. We use licensed waste transfer stations and disposal facilities wherever required by law.

7.2 On request, we may provide a waste transfer note or similar documentation for business customers where legally required, confirming the nature of the waste collected and the disposal route. You are responsible for retaining such documents for your records and regulatory compliance.

7.3 We reserve the right to refuse to collect any waste that we reasonably believe is hazardous, contaminated, illegal or unsuitable for our standard service. If such waste is discovered during a collection, we may suspend work, adjust the price, or require you to arrange specialist disposal through an appropriate contractor.

7.4 Once we have collected the waste from the site and you have paid the applicable charges, ownership of the waste transfers to us, and we will handle it in accordance with our environmental policies and legal obligations.

8. Liability and Limitations

8.1 We will exercise reasonable care when carrying out the services at your site. However, you are responsible for protecting any fragile surfaces, flooring, fixtures or fittings that may be susceptible to damage during the normal loading and removal of rubbish.

8.2 We will not be liable for minor scuffs, marks or damage that could reasonably be expected to occur in the normal course of moving bulky items, unless caused by our negligence. If you have particular concerns, you should notify our team before work begins.

8.3 If we are found liable to you for any loss or damage arising out of or in connection with the services, our total aggregate liability, whether in contract, tort or otherwise, shall be limited to the total price paid or payable by you for the specific services giving rise to the claim, except where such limitation is not permitted by law.

8.4 Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter where liability cannot lawfully be excluded or limited.

8.5 We will not be liable for any indirect or consequential loss, loss of profits, loss of business, loss of opportunity, or loss of data, arising from or in connection with the provision of our services or your use of them.

9. Insurance

9.1 We maintain appropriate public liability insurance and, where applicable, employer's liability insurance in connection with our rubbish removal and waste collection operations. Details of our insurance cover are available on request.

9.2 It is your responsibility to ensure that you have adequate insurance in place for your own property and belongings, including cover for any items that you wish to retain at the site.

10. Complaints and Disputes

10.1 If you are dissatisfied with any aspect of our services, you should notify us as soon as possible, ideally within 48 hours of the collection, so that we can investigate and, where appropriate, seek to resolve the issue.

10.2 We may ask you to provide photographs, descriptions or other evidence to help us assess your complaint. We will review the matter and respond within a reasonable timeframe, explaining any action we propose to take.

10.3 Nothing in this section affects your statutory rights under consumer protection legislation in the United Kingdom.

11. Personal Data

11.1 In order to provide our services, we may collect and process personal data about you, such as your name, contact details, site address, billing information and details of the services provided.

11.2 We will handle such personal data in accordance with applicable data protection laws and only for purposes connected with the provision and administration of our services, including bookings, payments, customer service and legal or regulatory compliance.

12. Amendments to Terms

12.1 We may update or amend these Terms and Conditions from time to time to reflect changes in our services, legal requirements or business practices. The version in force at the time of your booking will apply to that particular service, unless we agree otherwise in writing.

12.2 Any changes will normally be published or made available through our usual communication channels. You are advised to review the latest Terms and Conditions before making a new booking.

13. Severability

13.1 If any provision of these Terms and Conditions is found by a court or competent authority to be invalid, unlawful or unenforceable, that provision shall, to the extent required, be deemed deleted, and the remaining provisions shall continue in full force and effect.

14. Governing Law and Jurisdiction

14.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter or formation, shall be governed by and construed in accordance with the laws of England and Wales.

14.2 You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of our rubbish removal and waste collection services.

By making a booking with Rubbish Removal Haringey, you confirm that you have read, understood and agreed to these Terms and Conditions.
